1. Introduction

Welcome to DriveVerse, a social car community app with AI-powered diagnostic features. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully.

1.1 Acceptance of Terms

By creating an account or using DriveVerse, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

1.2 Age Requirements

You must be at least 16 years old to use DriveVerse independently. Users between 13 and 15 years old may only use the service with verifiable parental or guardian consent. Users under 13 are not permitted to use DriveVerse under any circumstances. By using DriveVerse, you represent that you meet these age requirements.

2. User-Generated Content

DriveVerse allows users to post car-related issues, discuss problems, and interact with other users and mechanics. You retain ownership of your content, but grant DriveVerse a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content on our service.

You are solely responsible for the content you post. Content must not be illegal, infringing, harmful, abusive, or otherwise objectionable. DriveVerse reserves the right to remove any content that violates these terms.

3. Sound Uploads and Vehicle Media

Our app allows users to upload sound recordings and photos related to car issues. These recordings and images must be your own original content or content you have permission to share. All uploads are subject to the same content guidelines as other user-generated content.

By uploading audio recordings, photos, or other media to DriveVerse, you acknowledge and agree that this data may be:

  • Processed by our AI systems for diagnostic analysis
  • Used to train, improve, and enhance our AI models and diagnostic capabilities
  • Shared with third-party AI service providers (including OpenAI) for processing and analysis
  • Stored in cloud services for the duration specified in our Privacy Policy

4. Community Moderation

DriveVerse employs community moderation to maintain a helpful and respectful environment. Moderators may remove content, issue warnings, or take other actions to enforce these terms. Users may also report inappropriate content for review.

5. DriveVerse Plus Subscriptions

DriveVerse offers an optional subscription service called DriveVerse Plus. This is a monthly auto-renewing subscription that unlocks premium features, including:

  • An ad-free experience
  • Access to latest AI models (GPT-4.5 and newer)
  • Unlimited photo uploads for diagnosis
  • Faster AI response times
  • Personalized responses based on your car's VIN and data
  • Advanced Car Health Score features
  • Premium Smart Buy reports
  • Additional upcoming premium features

5.1 Billing and Renewal

DriveVerse Plus can be purchased either through your Apple account (for in-app purchases) or via our website using Stripe (for web purchases). Apple subscriptions are billed at $9.99 per month (or equivalent in your local currency) and auto-renew unless canceled at least 24 hours before the end of the current billing cycle. Web subscriptions are billed securely via Stripe and also auto-renew monthly unless canceled before the end of the billing period.

5.2 Managing Subscriptions

For Apple in-app purchases, you can manage or cancel your subscription in your Apple ID account settings. For web purchases, you can manage or cancel your subscription at any time by clicking 'Manage Subscription' in your account settings, which will take you to our secure Stripe billing portal. Cancellation takes effect at the end of the current billing period. No refunds or partial credits will be issued for partial billing periods.

6. AI Diagnostics and Disclaimer of Professional Advice

6.1 Nature of AI Diagnostics

IMPORTANT: DriveVerse provides AI-powered vehicle diagnostic suggestions based on audio recordings, photos, vehicle information, and user-provided descriptions. These AI analyses are ESTIMATES ONLY and should NEVER be relied upon as professional automotive advice or diagnosis.

6.2 AI Limitations and Accuracy

Our AI diagnostic system:

  • May produce inaccurate, incomplete, or misleading information
  • Relies on limited input data (audio quality, photo clarity, user descriptions)
  • Cannot physically inspect your vehicle
  • May miss critical safety issues or underlying problems
  • Provides probability-based estimates, not definitive diagnoses
  • Is continuously learning and improving but is not perfect
  • May not account for vehicle-specific variations or modifications

6.3 No Warranty of Accuracy

DRIVEVERSE DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED DIAGNOSTIC INFORMATION OR COST ESTIMATES.

6.4 Professional Verification Required

YOU MUST VERIFY ALL AI DIAGNOSES AND RECOMMENDATIONS WITH A CERTIFIED, LICENSED AUTOMOTIVE PROFESSIONAL BEFORE TAKING ANY ACTION.

For safety-critical issues including but not limited to:

  • Brake systems
  • Steering and suspension
  • Engine failures or overheating
  • Transmission problems
  • Electrical system failures
  • Fuel system issues
  • Any warning lights or unusual vehicle behavior

SEEK IMMEDIATE PROFESSIONAL ASSISTANCE. DO NOT RELY ON AI DIAGNOSIS FOR SAFETY-CRITICAL ISSUES.

6.5 Community Advice

DriveVerse is a platform for car enthusiasts to share information and experiences. The advice, suggestions, and information provided by other users, including verified mechanics or community members, should not be considered professional advice. Even verified mechanics on the platform are providing informal suggestions, not professional diagnoses. Always consult with a qualified professional in person before making decisions about your vehicle's maintenance or repair.

6.6 No Professional Relationship

Use of DriveVerse does not create a mechanic-client relationship, professional services relationship, or any duty of care between DriveVerse, its AI systems, verified mechanics on the platform, or any users and you.

7. Acceptable Behavior

Users must treat others with respect. The following behaviors are strictly prohibited:

  • Harassment, hate speech, discrimination, or threatening behavior
  • Impersonating others or creating accounts for fraudulent purposes
  • Posting false, misleading, or intentionally harmful information
  • Spamming or excessive self-promotion
  • Sharing personal information of others without consent
  • Any illegal activity or promotion of illegal activity

Violations may result in content removal, account suspension, or permanent ban at DriveVerse's sole discretion.

8. Account Termination

8.1 By DriveVerse

DriveVerse reserves the right to suspend or terminate accounts that:

  • Violate these Terms of Service
  • Engage in illegal activity
  • Abuse the service or other users
  • Have been inactive for an extended period
  • For any other reason at our sole discretion

8.2 By You

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, though some content (such as community posts) may remain in an anonymized form.

9. Intellectual Property

9.1 DriveVerse IP

DriveVerse and its licensors own all rights, title, and interest in and to the DriveVerse app, including all software, AI models, algorithms, designs, trademarks, and other intellectual property. You may not copy, modify, reverse engineer, or create derivative works based on DriveVerse.

9.2 Your Content

You retain ownership of content you upload to DriveVerse. However, by uploading content, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your content for the purposes of operating and improving the service.

10. Changes to Terms

DriveVerse may modify these Terms of Service at any time. We will provide notice of material changes through the app or via email. For significant changes, we may require you to re-accept the updated terms before continuing to use the service.

Your continued use of the service after such modifications constitutes acceptance of the updated terms. If you do not agree to the modified terms, you must stop using DriveVerse and may delete your account.

11. Limitation of Liability

11.1 Use at Your Own Risk

YOU USE DRIVEVERSE ENTIRELY AT YOUR OWN RISK. ANY ACTIONS YOU TAKE BASED ON INFORMATION FROM THE APP, INCLUDING AI DIAGNOSTICS, USER ADVICE, OR MECHANIC SUGGESTIONS, ARE YOUR SOLE RESPONSIBILITY.

11.2 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVEVERSE AND ITS DEVELOPERS, OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Vehicle damage of any kind resulting from AI diagnoses, user advice, or actions taken based on app information
  • Personal injury, death, or bodily harm
  • Property damage to your vehicle or other property
  • Financial loss, repair expenses, or economic damages
  • Consequential, indirect, incidental, special, exemplary, or punitive damages
  • Lost profits, lost revenue, or business interruption
  • Loss of data or content
  • Cost of substitute services
  • Any damages arising from:
    • Use of or reliance on AI diagnostics or recommendations
    • Inaccurate, incomplete, or misleading AI information
    • User-generated content or community advice
    • Service interruptions or technical failures
    • Unauthorized access to your account or data
    • Third-party actions or content

11.3 Maximum Liability Cap

In jurisdictions where liability cannot be entirely excluded, our maximum aggregate liability to you for any claims arising from or related to DriveVerse shall not exceed the greater of:

  • $50 USD, or
  • The amount you paid to DriveVerse (if any) in the 12 months preceding the claim

11.4 Essential Provisions

You acknowledge that these liability limitations are an essential element of the agreement between you and DriveVerse, and that DriveVerse would not provide the service without these limitations.

12. Disclaimers and Warranties

12.1 Service Provided "AS IS"

DRIVEVERSE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Uninterrupted or error-free service

12.2 AI Disclaimer

WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF:

  • AI-generated diagnostic information
  • Cost estimates or repair suggestions
  • Car Health Scores or Smart Buy recommendations
  • Vehicle data or VIN decoder results
  • User-generated content or community advice

13. Indemnification

You agree to indemnify, defend, and hold harmless DriveVerse and its officers, directors, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of DriveVerse
  • Your violation of these Terms of Service
  • Your violation of any rights of another user or third party
  • Content you upload or post to DriveVerse
  • Actions you take based on AI diagnoses or community advice

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of DriveVerse shall be resolved through:

  1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
  3. Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to bring claims as part of a class action, collective action, or representative proceeding

14.3 Exceptions to Arbitration

The following may be brought in small claims court or, where applicable, in state or federal court:

  • Intellectual property disputes
  • Claims for injunctive relief
  • Disputes that cannot be arbitrated under applicable law

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and DriveVerse regarding use of the service and supersede any prior agreements.

17. No Waiver

DriveVerse's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or your DriveVerse account to any third party without our written consent. DriveVerse may assign these Terms to any successor or affiliate without restriction.

20. Acknowledgment and Acceptance

  • ✓ DriveVerse AI is not a replacement for professional automotive diagnosis
  • ✓ AI may provide inaccurate, incomplete, or misleading information
  • ✓ You will verify all diagnoses with certified professionals before taking action
  • ✓ You use DriveVerse entirely at your own risk
  • ✓ DriveVerse is not liable for any vehicle damage, personal injury, or financial loss
  • ✓ You consent to your data being used as described in our Privacy Policy
  • ✓ You meet the age requirements to use the service
